END-USER LICENSE AGREEMENT (EULA)
This End-User License Agreement for Grow Biointensive Diet Design and Planning Software ("SOFTWARE
PRODUCT") is a legal agreement between you (either an individual or an entity) and Ecology Action
("AUTHOR").
You agree that your use of the SOFTWARE PRODUCT acknowledges that you have read this license,
understand it, and agree to be bound by its terms and conditions.
IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT, DO
NOT INSTALL AND/OR USE THIS SOFTWARE.
1. LICENSE GRANT
The SOFTWARE PRODUCT is licensed, not sold, to you by AUTHOR for use only under the terms of this
License, and AUTHOR reserves any rights not expressly granted to you. All LICENSES grant end-user use on
ONE computer only. The computer that the SOFTWARE PRODUCT is installed on is the ONLY computer that
will permit licensed use.
1.1 LICENSE TYPES
AUTHOR provides the following types of licenses - EVALUATION LICENSE (TRIAL MODE),
STANDARD USER LICENSE, and STUDENT USER LICENSE.
Before purchasing a license, you have to install the trial version of the SOFTWARE PRODUCT and verify that
the SOFTWARE PRODUCT is working correctly and as expected on your computer.
With the STANDARD and STUDENT licenses, you are granted an indefinite period of software use on one
computer, and a one-year maintenance period of SOFTWARE PRODUCT updates (when available) from the
date of purchase. Upon expiration, you need to renew maintenance at 30% of the current LICENSE price to
obtain another year of SOFTWARE PRODUCT updates. Otherwise, you may stay with your latest version of
the SOFTWARE PRODUCT.
With the STANDARD and STUDENT licenses, you are also granted 10 minutes of free technical support via
email. Thereafter, technical support will be available in 15-minute increments at the current hourly technical
support fee ($30/hr as of May 2010).
1.2 EVALUATION LICENSE ENTITLEMENT
The EVALUATION LICENSE ENTITLEMENT only applies when you obtain a copy of the SOFTWARE
PRODUCT for the first time. You may use the Evaluation (Trial) Version of the SOFTWARE PRODUCT for a
5-day evaluation period. After the evaluation period, if you want to continue to use the SOFTWARE
PRODUCT you must purchase the required number of STANDARD or STUDENT Licenses from AUTHOR.
Packages created with the SOFTWARE PRODUCT under EVALUATION LICENSE are able to work for 5
days, CANNOT be used for commercial purpose, and contain the references to AUTHOR and SOFTWARE
PRODUCT.
1.3 STANDARD USER LICENSE ENTITLEMENT
The STANDARD USER LICENSE ENTITLEMENT only applies after you have purchased the STANDARD
USER LICENSE from AUTHOR. AUTHOR grants to you a personal, non-transferable and non-exclusive right
to use the copy of the SOFTWARE PRODUCT provided with this License.
The STANDARD USER LICENSE authorizes you to use one copy of this SOFTWARE PRODUCT on a single
computer. You are authorized to use our product for commercial purposes, but NOT authorized to use our
product as part of a SERVICE to third party developers or customers.
1.4 STUDENT LICENSE ENTITLEMENT
The STUDENT LICENSE ENTITLEMENT only applies after you have purchased the STUDENT LICENSE
from AUTHOR, subject to student-status eligibility. AUTHOR grants to you a personal, non-transferable and
non-exclusive right to use the copy of the SOFTWARE PRODUCT provided with this License.
The STUDENT LICENSE authorizes you to use one copy this SOFTWARE PRODUCT on a single computer.
STUDENT LICENSE cannot be used for commercial purposes and is NOT authorized for use as part of a
SERVICE to third party developers.
1.5 COMMERCIAL USE RESTRICTION
ALL of the above LICENSES are intended for use by an end-user on one computer.
NONE of these LICENSES permit commercial consulting work for third parties, using this SOFTWARE
PRODUCT. This use of the SOFTWARE PRODUCT is permitted only with a COMMERCIAL LICENSE not
covered by this End-User License Agreement (EULA). For details about terms and pricing of the COMMERCIAL LICENSE, please contact Ecology Action directly using the contact information that follows.
2. ORDERING

Your order will require your computer's "HARDWARE ID". This can be accessed in the following ways:
EXPIRED TRIAL VERSION – Press the "Copy Hardware Id" button on the expired software dialog box before
proceeding to place your online order.
UNEXPIRED TRIAL VERSION – In the software, select the following menu items:
DoneEx -> Application Diet Design Planning -> About Then press the "Copy Hardware Id" button on the “About” dialog box before proceeding to place your online
order.

3. NO REFUND
No refund is given at any time, unless authorized by the AUTHOR under unexpected circumstances. The
AUTHOR reserves the right to provide refunds, or make any commercially reasonable efforts to solve any
issues at his discretion. Please contact the AUTHOR to see if you qualify for a refund.
4. DISCLAIMER OF WARRANTY AND LIABILITY
THIS SOFTWARE IS PROVIDED ON AN "AS IS" BASIS. AUTHOR DISCLAIMS ALL WARRANTIES
RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT
LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE. NEITHER AUTHOR NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN
THE CREATION, PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY
INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR
INABILITY TO USE SUCH SOFTWARE, EVEN IF AUTHOR HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES OR CLAIMS. THE PERSON USING THE SOFTWARE BEARS ALL
RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE.
5. EXCEPTIONS
No exceptions to any portion of this license agreement will be allowed without the express written permission
of AUTHOR.
